Notice of intent to discontinue class action for unpaid overtime

A claim was filed under the Ontario Class Proceedings Act by former employees of iQor Inc. and its predecessor, Canadian Bonded Credit Limited, for compensation for unpaid overtime. On October 15, 2014, the Ontario Superior Court of Justice granted leave to discontinue the class action.

Who are the proposed class members?

Proposed class members are former employees of iQor Inc. and its predecessor, Canadian Bonded Credit Limited, who:

  • were required to work in excess of the permissible Ontario overtime threshold of 44 hours;
  • were not paid for these excess hours in accordance with section 22(1) of the Ontario Employment Standards Act, and
  • who believe that they are not exempted from the overtime threshold requirement of section 22(1) or the maximum workweek of 48 hours of section 17(1)(b) of the Employment Standards Act.

When will this action be discontinued?

The action will be discontinued on December 15, 2014.
